FIFA dismissed Kenyan footballer Amos Nondi's claim against FC Dila Gori, citing sufficient contractual fulfillment by the club.

Kenya international Amos Nondi faced a major setback in April 2023 when his compensation claim against Georgian National League side FC Dila Gori was rejected by FIFA.

The detailed reasons behind this decision remained under wraps until recently, shedding light on the complexities of football contracts and player-club disputes.

Nondi's claim centered around unpaid salaries and bonuses, which he alleged totaled $5,700 USD (Ksh 906,300), along with additional interest. The dispute brought into focus the often murky world of football contracts and the challenges players face in securing their dues.

In his claim, Nondi argued that Dila Gori owed him salaries for November and December 2022, along with various bonuses stipulated in his contract. These included lineup bonuses for starting in the first eleven and victory bonuses for the last five matches of the season.

According to Nondi, these amounts were not fully paid, leading to a substantial shortfall in what he was owed.  "The monthly salary stipulated in the article 1.2.1 is $ 2,600 net. As the contract was expiring on 15/12/2022, the remuneration was supposed to be $ 29,900 which is equivalent to 85,000 GEL (according the medium 2022 rate)” and “$ 4,050 should have been paid to me according the article 1.2.2 of my contract.”

However, the club presented a different story. They argued that they had fulfilled all contractual obligations towards Nondi.

The Georgian side detailed the payments made, including monthly salaries, lineup bonuses, and additional allowances. They even pointed out that certain deductions were made due to disciplinary violations by Nondi, a claim that the player contested.

The single Judge at FIFA, after a thorough review of the case, concluded that Nondi had, in fact, received more than he was contractually entitled to.

"In view of the above, the Claimant effectively received the amount of GEL 100,751.99 (Ksh 5.9million) , even though being entitled to GEL 83,055.71 (Ksh 4.9million) ," reads part of the ruling.

One of the critical points of contention was the club's responsibility for Nondi's housing arrangements. While the player argued that the club failed to substantiate expenses related to his accommodation, the Judge found no basis for deductions concerning accommodation and declared any such deductions null and void.

In an interesting twist, the Judge also highlighted the lack of evidence from the club regarding the alleged disciplinary violations. Without concrete proof, these fines imposed on Nondi were rendered invalid.

However, this did not sway the overall decision, as the Judge found that Nondi had already received more than his due.

The ruling was also notable for its adherence to FIFA's procedural rules, emphasizing that no procedural costs or compensation would be imposed on either party, in line with the provisions that protect players and other football professionals in such disputes.
