Police told the court that Olaba had approached another party seeking ways to eliminate a key witness in the rape case.

Former Kenya Harlequins, and Shujaa player Alex Olaba, who was charged with trying to hatch a plot to kill a witness in a gang rape case, has been found guilty of conspiracy to commit murder by a city court.

Magistrate Geoffrey Onsarigo found Olaba guilty of attempting to kill a key witness in 2021.

Olaba was charged alongside former team mate Frank Wanyama, the player he was accused of committing the crime with

"Having gone through the evidence in this case, I find the accused guilty of the offense," the magistrate ruled.

The court is expected to give its ruling on May 18, 2023.

Olaba was arrested at Madaraka Estate, Nairobi in 2022 by undercover detectives on the night he was planning the said murder. Police told the court that Olaba had approached another party seeking ways to eliminate the witness in the case before police were informed.

The approached party was apparently an undercover officer according to the police. It is alleged that on diverse dates between April 14 and 22 back in 2022, jointly with other suspects, he conspired to kill the unnamed witness.

The second count states that on April 22, 2022, Olaba interfered with the trial process in the gang rape matter, by attempting to cause the death of the key witness..

Olaba, an Alliance High school alumni and a Strathmore University student was seemingly destined for the top considering his educational background and his excellent rugby career.

However, a terrific night party in 2018 changed his life forever. In a shocking revelation, a musician named "Wendy Kemunto" accused both players of gang-raping her.

The two players, however, insisted in court that the ''sex'' was mutually agreed. The court found them guilty and sentenced them to 15 years in jail.

In 2020 both launched an appeal and their defense noted a loophole. The key witness gave unsworn evidence in the rape case. The lawyers argued that in criminal cases, sworn evidence is key.

The appeal turned out to be successful. The court quashed the sentence and ordered a fresh trial.

The appeal was successful as it gave room for Olaba and Wanyama to package their defense and face the rape case in full understanding. Both were released on Ksh300,000 cash bail.
