The ruling now means that Mwendwa is free to resume his role as the FKF boss.

Embattled Football Kenya Federation president Nick Mwendwa is now a free man after the charges concerning embezzlement of federation funds amounting to Sh38 million were dropped due to what the judge considered unconstitutional.

This comes after the Principal Magistrate, Wilson Rading, blocked the Director of Public Prosecutions (DPP) Noordin Haji from charging Mwendwa.

“This honorable court hereby issues orders to the effect that the charge sheet dated 7th July 2022 and/or any other charge sheet prepared and registered in this court by the DPP and/or his prosecutor(s) against the accused person after 6th July,

2022 be and is hereby struck out for being defective, unlawful, unconstitutional, and for being an abuse of the court process/criminal justice system,” the statement read in part.

The ruling now means that Mwendwa is free to resume his role as the FKF boss. He stepped down as FKF boss in November 2021 to pave way for seamless investigations to be done.
