Gor Mahia Fined Ksh 300,000 for Chaos as Loss to Bidco United Comes Back to Haunt Them

Gor Mahia's difficult start to the season took another hit with a fine for a security breach during their opening loss to Bidco United, despite the team going unbeaten in their four matches since.

The Football Kenya Federation (FKF) Disciplinary Committee has taken action against Gor Mahia FC following a security lapse during their Football Kenya Federation Premier League fixture against Bidco United on September 21, 2025, at Kasarani Stadium.

The match, which marked Gor Mahia’s season opener, ended in a 1-0 defeat for the 21-time Kenyan champions. Following a review, the FKF Disciplinary Committee found the club responsible for failing to provide adequate security and maintain proper order during the encounter.

In a ruling issued on October 31, 2025, the Committee determined that Gor Mahia’s actions breached both FKF Competition Regulations and the CAF Disciplinary Code.

The governing body underscored that, despite the club’s use of third-party service providers for essential operations such as ticketing and access control, Gor Mahia ultimately bore a non-delegable duty of care for the safety and orderly conduct of the match.

Gor Mahia: Strict Liability and Club Responsibility

The FKF Disciplinary Committee’s ruling strongly relied on the principles of Strict Liability and Vicarious Liability.

Under the standard of Strict Liability, a club is held responsible for incidents that occur in or around the stadium, even if there is no fault or negligence on its part.

Furthermore, the doctrine of Vicarious Liability extends this responsibility to cover the acts or omissions of their service providers, contractors, or any other parties acting on behalf of the club.

The Committee noted that outsourcing operational functions, like security or ticketing, does not absolve a club from its inherent responsibility under the CAF and FIFA disciplinary frameworks. These frameworks require clubs to always exercise proper oversight and preventive measures.

As a result of their findings, the FKF Disciplinary Committee has imposed a three-part sanction on Gor Mahia FC. The club has been formally found culpable for failing to maintain adequate order and security.

A formal warning has also been issued, instructing the club to exercise its duty of care on matchdays more diligently. A fine of KES 300,000 has been imposed, which the club must pay within fourteen (14) days.

The Committee issued a stern warning that any recurrence of similar security incidents will lead to "more severe sanctions".

The detailed legal analysis, known as the Reasoned Decision, will be issued on November 4, 2025, which will then mark the beginning of the club's right of appeal as provided under the FKF Rules & Regulations (2024).
