Maxine is expected to be arraigned in court on Wednesday 8 March to answer to the charges, according to the Director of Public Prosecutions (DPP).

In February, Milimani Senior Principal Magistrate Bernard Ochoi granted the DPP and the Directorate of Criminal Investigations (DCI) 15 days to file a report on whether they were going to charge the rally driver.

The magistrate has now confirmed that the DPP has arrived at a decision to charge Wahome with murder.

"The prosecutor has indicated that the DPP has now made a decision to charge the respondent with a count of murder, and he has further informed the court that the respondent is required to appear before the high court today [Tuesday] virtually for directions by the high court judge in view of that application, and this miscellaneous application is closed, "Magistrate Ochoi, noted, as quoted by NTV.

The DPP also wants Wahome to remain at the Kilimani Police Station and undergo a mental assessment before taking a plea.

Wahome was set to stand trial for causing grievous bodily harm, but that changed after Khan died in the hospital from the injuries he suffered during the scuffle.

Khan died in December 2022, and Wahome remains the primary suspect in the case.
